Terms of Service

1. Acceptance of Terms

By accessing or using the Earnify platform (the "Platform"), operated by ABODIGITAL (Pty) Ltd, which owns Earnify ("Earnify," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy.

If you do not agree to these Terms, you must not access or use the Platform. Your continued use of the Platform constitutes your ongoing acceptance of these Terms and any amendments thereto.

These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and the Protection of Personal Information Act 4 of 2013 (POPIA).

2. Eligibility

To use Earnify, you must:

• Be at least 18 years of age or have the consent of a legal guardian.
• Be a resident of the Republic of South Africa.
• Possess a valid South African mobile phone number (required for registration and verification).
• Have the legal capacity to enter into a binding agreement.
• Not have been previously banned or suspended from the Platform.

By registering, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time and to suspend or terminate accounts that do not meet these criteria.

3. Account Registration and Security

When you register for an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate.
• Keep your password confidential and not share it with any third party.
• Notify us immediately of any unauthorised access to or use of your account.
• Accept responsibility for all activities that occur under your account.

You may only create and maintain one (1) account per person. Creating multiple accounts is strictly prohibited and will result in the suspension of all associated accounts and forfeiture of all accumulated points.

4. How the Platform Works

Earnify is a rewards platform that allows registered users to earn points by completing various tasks. These tasks may include:

• Video Tasks: Watching brand advertisements or promotional videos to completion.
• Survey Tasks: Answering consumer research surveys honestly and completely.
• Quiz Tasks: Completing knowledge-based quizzes with verification questions.
• App Install Tasks: Downloading and installing specified mobile applications.
• Daily Challenges: Special time-limited tasks that offer bonus points.

Each task has a defined point value displayed before you begin. Points are credited to your wallet upon successful verification of task completion. We reserve the right to modify, add, or remove task types and their point values at any time.

Task availability may vary based on your account tier, location, device, and advertiser demand. We do not guarantee a minimum number of available tasks at any time.

5. Points System

• Earning: Points are earned by completing verified tasks. Points are credited immediately upon successful task verification, or within a reasonable processing period for tasks requiring manual review.
• Expiry: Points expire after 180 consecutive days of account inactivity. Inactivity means no login, task completion, or withdrawal activity. We will attempt to notify you via SMS or email at least 14 days before points expire.
• Non-Transferable: Points cannot be transferred between accounts, sold, bartered, or exchanged outside of the Platform's official withdrawal mechanisms.
• No Monetary Value Until Withdrawn: Points have no cash value until a withdrawal request is successfully processed. Points do not constitute currency, property, or a stored value instrument.
• Daily Earning Cap: A daily earning cap applies to prevent abuse. The cap varies by account tier (see Section 9). Earnings beyond the daily cap will not be credited.
• Tier Multipliers: Higher account tiers may earn bonus multipliers on task points (e.g., Gold tier earns 1.5x points).
• Rate Changes: We reserve the right to modify the points-to-Rand conversion rate with 30 days' prior notice to users.

6. Withdrawal Terms

6.1 Minimum Withdrawal Amounts

• Retail Vouchers: Minimum 500 points (R5.00)
• Bank Transfer (EFT via Ozow): Minimum 2,000 points (R20.00)
• Capitec Pay: Minimum 1,000 points (R10.00)

6.2 KYC Requirements

For withdrawals exceeding R500 (50,000 points) cumulatively, or as required by FICA regulations, you must complete Know Your Customer (KYC) verification by providing a valid South African ID document and proof of address.

6.3 Processing Times

• Retail vouchers: Typically delivered within 1-24 hours via email.
• Bank transfers: Typically processed within 24-72 business hours.
• Capitec Pay: Typically processed within 1-24 hours.

Processing times are estimates and may be affected by banking systems, voucher provider availability, public holidays, or technical issues. We are not responsible for delays caused by third-party payment providers.

6.4 Fees

A processing fee of up to 5% may be deducted from withdrawal amounts. The exact fee will be displayed before you confirm your withdrawal request. We reserve the right to modify fee structures with prior notice.

6.5 Withdrawal Limits

Daily and monthly withdrawal limits may apply based on your account tier and KYC verification status. These limits are in place to comply with financial regulations and prevent fraud.

8. Anti-Fraud Measures and Consequences

We employ sophisticated fraud detection systems including IP analysis, device fingerprinting, behavioural analytics, and third-party verification services. If fraudulent activity is detected or suspected:

• Your account may be immediately suspended pending investigation.
• All accumulated points may be forfeited without compensation.
• Pending withdrawal requests may be cancelled.
• Your account may be permanently terminated.
• We may report fraudulent activity to relevant South African law enforcement authorities.
• We reserve the right to recover any amounts paid out as a result of fraudulent activity.

Our fraud determination is made at our sole discretion. You may appeal a fraud determination by contacting support@earnify.co.za within 14 days of notification.

9. Account Tiers

Earnify operates a tiered account system that rewards consistent, legitimate usage:

Tier status is evaluated periodically. Accounts may be demoted if activity levels drop below tier requirements. Tier benefits are subject to change with notice.

10. Referral Program

• Each user receives a unique referral code upon registration.
• When a new user registers using your referral code and completes their first task, both you and the referred user earn a referral bonus.
• Referral bonuses are subject to change and will be displayed on the referral page.
• Self-referrals (referring your own alternate accounts) are prohibited and constitute fraud.
• Mass-spamming referral codes on social media or through unsolicited messages is prohibited.
• We reserve the right to modify, suspend, or terminate the referral program at any time.
• Referral bonuses may be clawed back if the referred user's account is found to be fraudulent.

11. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, audio, video, software, and the overall design — are the exclusive property of ABODIGITAL (Pty) Ltd, which owns Earnify, or its licensors and are protected by South African and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Platform content without our prior written consent.

12. Limitation of Liability

To the maximum extent permitted by South African law, including the Consumer Protection Act:

• Earnify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
• Our total aggregate liability for any claims arising from these Terms or your use of the Platform shall not exceed the total amount of Rands actually withdrawn by you in the 12 months preceding the claim.
• We are not liable for any loss of points, data, or earnings resulting from system failures, security breaches, or events beyond our reasonable control.
• We do not guarantee any specific level of earnings or the continuous availability of tasks.

13. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that task results or point calculations will always be accurate.

14. Indemnification

You agree to indemnify, defend, and hold harmless ABODIGITAL (Pty) Ltd, which owns Earnify, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your use of or access to the Platform.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Any fraudulent or illegal activity conducted through your account.

15. Termination and Suspension

15.1 Termination by You

You may close your account at any time by contacting support@earnify.co.za. Before closure, you should withdraw any available balance above the minimum withdrawal threshold. Points below the minimum withdrawal threshold will be forfeited upon account closure.

15.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason including but not limited to:

• Violation of these Terms or any applicable policy.
• Suspected fraudulent activity.
• Extended account inactivity (180+ days).
• Legal or regulatory requirements.
• Discontinuation of the Platform or any part thereof.

15.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. Any points remaining in your account at the time of termination for cause (e.g., fraud) will be forfeited. For voluntary termination, you will have 30 days to withdraw eligible balances.

16. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.

• Any dispute arising from these Terms shall first be addressed through good-faith negotiation between the parties.
• If negotiation fails, disputes shall be submitted to mediation in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
• If mediation fails, disputes shall be resolved by the courts of the Republic of South Africa, Gauteng Division, Johannesburg.
• Nothing in this clause limits your right to approach the National Consumer Commission or any other regulatory body.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, epidemics, or pandemics.
• Load-shedding or power outages as implemented by Eskom or municipal authorities.
• Internet or telecommunications infrastructure failures.
• Government actions, sanctions, or regulatory changes.
• Civil unrest, strikes, or labour disputes.
• Cyberattacks, DDoS attacks, or other security incidents.
• Failures of third-party service providers (payment processors, mobile networks).

18. General Provisions

18.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18.2 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Earnify regarding your use of the Platform, superseding any prior agreements or understandings.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18.5 Amendments

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
